Cancellation

Any Capitalized terms used but not defined herein shall have the meaning assigned to them under the Terms of Use which govern your use of our website www.tryontrends.com (the “Website”) and our ‘“Try on Trends”’ application for mobile/web page \ and handheld devices (the “App”). The Website/web page and the App are jointly referred to as the “Platform”.

1. Cancellation Policy

1. a) As a general rule Buyer shall not be entitled to cancel Order once placed. Buyer may choose to cancel Order only within SIX HOURS FROM THE TIME of the Order being placed. However, subject to Buyer’s previous cancellation history, “Try on Trends” reserves the right to deny any refund to Buyer pursuant to a cancellation initiated by Buyer, even if the same is within one-minute followed by suspension of account, as may be necessary in the sole discretion of “Try on Trends”. 

1. b) If Buyer cancels his/her Order after SIX HOURS FROM THE TIME of placing it, “Try on Trends” shall have a right to collect a penalty of 25% of the total order value for breach of contract terms suffered by “Try on Trends” and the merchant; where 15 % of the total value of the order will be transferred to the merchant and 10% of the total order value shall be retained by “Try on Trends” towards the order processing fee on the platform.

 

1. c) The 10% of the total order value retained by “Try on Trends” towards the service rendered for processing the order on the platform as mentioned in “Clause b” above is for the exclusive benefit of Tryon Trends and the same unquestionable by anyone.

 

2. Non-Customer Cancellation

 

a).  “Try on Trends” reserves the right to collect a penalty for the Orders constrained to be cancelled by “Try on Trends” for reasons not attributable to “Try on Trends”, including but not limited to:

 

1. i) in the event if the address provided by Buyer is either wrong;

failure to contact Buyer by phone or email at the time of delivering the Order booking;

 

1. ii) failure to deliver Buyer Order due to lack of information, direction or authorization from Buyer at the time of delivery; or

 

iii)  unavailability of all the items ordered by Buyer at the time of booking the Order; or

 

1. iv) unavailability of all the items ordered by Buyer at the time of booking the Order. However, in the unlikely event of an item in an Order being unavailable, the merchant will contact the Buyer on the phone number provided at the time of placing the Order and inform Buyer of such unavailability. In such an event Buyer will be entitled to cancel the entire Order and shall be entitled to a refund to an amount upto 100% of the Order value.

 

v).   In case of cancellations for the reasons attributable to “Try on Trends” or the Merchant “Try on Trends” shall not collect any penalty from the Buyer.
